1. Who We Are

ProfileHero.ai is operated in the United Kingdom. We provide AI-based image generation services designed to create professional-style headshots from user-uploaded photos.

2. Our Service

ProfileHero.ai uses artificial intelligence to generate headshots based on the photos you upload.

You acknowledge that:

• The results are AI-generated and may not perfectly represent reality.
• Output quality depends on the suitability and clarity of your uploaded photos.
• We may modify, improve, or discontinue parts of the Services at any time without notice.
• Our Services are provided on a pay-per-use basis. There are currently no subscriptions or recurring payments.

3. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using our Services, you confirm that:

• You have the legal authority to enter into these Terms.
• You have the necessary rights and permissions to upload all content you provide.
• You will not upload or request images of anyone without their consent.

4. User Accounts and Third-Party Sign-In

You may create an account using a secure emailed magic link or code, or by signing in through a third-party service such as Google, Facebook, LinkedIn, or other supported providers.

By using a third-party sign-in, you authorise us to receive limited account information (such as your name, email address, and profile image) from that provider, as described in our Privacy Policy. We do not receive or store your third-party passwords.

You are responsible for:

• Maintaining the confidentiality of your account credentials (regardless of sign-in method).
• All activity that occurs under your account.

Notify us immediately of any unauthorised access or suspected security breach.

5. Uploaded Content and Generated Images

When you upload photos or other materials ("User Content"), you:

• Grant ProfileHero.ai a worldwide, non-exclusive, royalty-free licence to store, process, and use your User Content solely to deliver and improve the Services.
• Confirm you have lawful rights and permissions to use and upload all such content.

Once your AI-generated headshots ("Generated Images") are produced:

• You retain full ownership and commercial rights to all Generated Images created through our Services.
• ProfileHero.ai does not claim ownership of your Generated Images but retains a limited, revocable licence to use them (in anonymised or non-identifiable form) for promotional, illustrative, or portfolio purposes, such as displaying example results on our website or in marketing materials.
• We will not use any recognisable Generated Images for public display or promotional use without your explicit consent, except where Services are provided free of charge under a discount, promotion, or competition, in which case such usage rights are retained by ProfileHero.ai.

We do not use your images or generated outputs to train AI models unless you have provided specific, informed, opt-in consent.

6. Payments and Refunds

All payments are processed securely via third-party payment providers such as Stripe and PayPal. Prices are displayed on our website and may change periodically, though such changes do not affect purchases already completed.

Refunds are governed by our Refund & Money-Back Guarantee Policy, which offers a 7-day guarantee if defined criteria are met.

By completing your purchase, you acknowledge that generation begins immediately and you waive your standard cancellation right once processing starts.

7. Prohibited Uses

You agree not to:

• Upload or request content that is unlawful, defamatory, explicit, discriminatory, or infringes on others' rights.
• Use the Services to impersonate others or create deceptive or harmful content.
• Reverse engineer, reproduce, or misuse any part of our Services, software, or AI models.

Violations may result in account termination or legal action.

8. Intellectual Property

All intellectual property in the Services, including code, algorithms, AI models, design, and branding, remains the property of ProfileHero.ai or its licensors (including trusted partners such as Astria, Replicate, and Cloudinary).

Nothing in these Terms grants you ownership of our technology or systems.

9. Data Protection and Privacy

We collect and process personal data in accordance with our Privacy Policy, which explains:

• What data we collect (including uploaded photos, user-provided and AI-derived characteristics).
• How it's used, stored, and shared.
• Your rights under the UK GDPR and EU GDPR.
• Our use of secure service partners including Astria, Replicate, and Cloudinary for data processing and storage, and Stripe and PayPal for payment processing.
• Our use of analytics and advertising services (including Google Analytics, Meta (Facebook) Pixel/Ads, LinkedIn Ads, Reddit Ads, and similar tools) to understand usage patterns, improve the Services, and support marketing efforts.

We take reasonable steps to ensure all third-party providers maintain appropriate data protection and security standards.

10. Third-Party Services

To provide our Services, we use trusted third-party processors under terms consistent with data protection laws. These include Astria, Replicate, Cloudinary, Stripe, PayPal, and authentication providers (Google, Facebook, LinkedIn). They may process limited user data solely to perform their functions.

11. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. We make no warranties that:

• The Services will always be error-free or uninterrupted.
• The Generated Images will meet all personal expectations.
• Uploaded files will always yield usable results.

To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law:

• ProfileHero.ai shall not be liable for any indirect, incidental, or consequential damages (including loss of data, profits, or reputation).
• Our total liability for any claim will not exceed the amount paid for the specific service giving rise to that claim.

Nothing limits our liability for death or personal injury caused by negligence or for fraud.

13. Termination

We may suspend or terminate your account or access to the Services if you breach these Terms or misuse the platform. You may stop using the Services at any time.

Termination does not affect your rights to use previously generated images unless termination results from unlawful use or a refund request, in which case ProfileHero.ai may revoke access to generated results associated with the refunded transaction.

14. Changes to These Terms

We may update these Terms periodically. Revised versions will be posted with a new "Last updated" date.

Continued use of the Services after updates constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by English law, and any disputes will fall under the exclusive jurisdiction of the courts of England and Wales.
